Heavyweight House watchdogs are snarling for the raw records. Judiciary Committee Chair Jim Jordan got together with his associates, Oversight Committee Chair James Comer and Ways & Means Committee Chair Jason Smith, to write another letter calculated to make Merrick Garland turn purple. This time, they’re demanding “any records, including recordings, related to Biden’s interview with Hur’s team.” Oh, by the way, while you’re at it, throw in all the “classified documents identified in the report related to Ukraine.

House zeroes in on records

Heavy duty House investigators of the conservative Republican variety are asking Attorney General Merrick Garland, nicely, to hand over the evidence they need against Joe Biden. The DOJ is well familiar with the drill. They can ignore the request, then comes the subpoena.

Garland thought he could also ignore the subpoenas, because he has no intention of prosecuting the contempt of Congress charges for ignoring them. Congress found a way around that. Ignoring subpoenas now gets a civil suit in federal court with Congress as a party. That means these watchdogs really do have teeth.

Because these three committee chairmen, in particular, are the ones doing the asking, they have even more power than usual.

They happen to be jointly running the Joe Biden impeachment investigation and the document giving them their authority spells out to the DOJ that anything they ask for in that capacity has to be forked over to the House or it’s automatically considered a crime.

Not only are the Republicans demanding the records, they’re “in talks with” Robert Hur, “to have him testify about his report.” Garland has until “5 p.m. on February 19 to hand over the requested materials.

After that, he turns into a pumpkin. The House is “prepared to compel the production of this material if necessary.” As Christopher Wray and Janet Yellen learned the hard way, they mean it.

 

The infamous interview

If Joe Biden really did lose his mind enough that he’s not competent to stand trial for willfully retaining and passing around classified documents, Congress has the right to know it.

As soon as they read the publicly available version of Special Prosecutor Robert Hur’s report, the House wanted to see the clean source material to verify the truth. “For our investigatory purposes, the Committees require certain records relating to Mr. Hur’s investigation and report.

Specifically, they “require this transcript and any other records of this interview, including, but not limited to, any recordings, notes, or summaries of the interview.” It’s bad enough, the House notes to Garland, that the report describes Slow Joe as a “sympathetic, well-meaning elderly man with a poor memory.

Joe’s handlers came unglued and say the Special Prosecutor went off the reservation. They can demand apologies and retractions but it’s too late to put the genie back in the bottle.

The latest solution that Democrats have to “prove” that Joe is still capable of making daily decisions on national security matters is to put him out in public. That way people can see just how sharp he is.

In the first opportunity, he was filmed wandering aimlessly around the podium. The House wants the first generation source records for evidence because it’s clear that the only reason Joe’s not allowed to take a mental fitness test is because everyone is certain he would flunk.
