Planned Parenthood has belatedly reacted to the leaked Supreme Court draft that would reverse Roe v. Wade, describing the possible choice as “horrifying” and “devastating.” The 98-page draft viewpoint composed by Justice Samuel Alito is the very first file of this magnitude to be leaked from the Supreme Court. It was released on the evening of May 2nd after being leaked to Politico.
In the draft opinion from February, Justice Alito found that “Roe was egregiously wrong from the start” and “we hold that Roe and Casey must be overruled.”
“It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives,” the draft, titled “Opinion of the Court” continued.
In a press release about the devastating leaked ruling, Alexis McGill Johnson, president and CEO, Planned Parenthood Federation of America, said, “let’s be clear: Abortion is legal. It is still your right.” a position utterly antithetical to Justice Alito’s.
“This leaked opinion is horrifying and unprecedented, and it confirms our worst fears: that the Supreme Court is prepared to end the constitutional right to abortion by overturning Roe v. Wade,” McGill continued. “While we have seen the writing on the wall for decades, it is no less devastating, and comes just as anti-abortion rights groups unveil their ultimate plan to ban abortion nationwide. Understand that Planned Parenthood and our partners have been preparing for every possible outcome in this case and are built for the fight. Planned Parenthood health centers remain open, abortion is currently still legal, and we will continue to fight like hell to protect the right to access safe, legal abortion.”
The press release further noted in alarm that “though the decision is not yet final and abortion remains legal, if this decision issues, 26 states are poised to move quickly to ban abortion, leaving more than 36 million women of reproductive age — and other people who can become pregnant — without abortion access.”
Roe v. Wade stays in place till the viewpoint is signed. Drafts and votes might alter till that point.
Laws relating to abortion will be left for specific states to choose if it is reversed.
Planned Parenthood is the country’s leading company and supporter of abortion in the United States and has more than 600 centers throughout the country.
According to Politico, “the three Democratic-appointed justices – Stephen Breyer, Sonia Sotomayor and Elena Kagan – are working on one or more dissents,” it added that “How Chief Justice John Roberts will ultimately vote, and whether he will join an already written opinion or draft his own, is unclear.”
Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett had voted with Alito — per the Politico report. Even if Roberts should dissent, if the vote has already taken place and the five more conservative justices persist, a ruling against Roe v. Wade seems inevitable.
