Mayorkas Overstepped His Authority Here

ICYMI – When Domestic Security Minister Alejandro Mayorkas allowed “tens of thousands of Venezuelans to enter the U.S. using humanitarian parole,” he committed a “flagrant violation” of federal law. The move seriously overstepped his authority and hopping mad Republicans are going to throw the incident on their pile of pending investigations.

Top Republicans on the House and Senate Judiciary Committees are howling for the head of Alejandro Mayorkas on a symbolic plate.

They’re demanding the Biden regime cough up details on their “recently announced program.” The one that “would allow tens of thousands of Venezuelans to enter the U.S. using humanitarian parole.” That, they insist, is a “flagrant violation” of federal law.

The Department of Homeland Security, headed by Mayorkas, created a new “categorical parole program for Venezuelan nationals” out of thin air. When did DHS get authority to create laws? That’s a violation of union rules.

In another one of their nastygrams to the palace, Representative Jim Jordan and Senator Charles Grassley, the ranking Republicans on the House and Senate Judiciary Committees, are demanding answers.

Mayorkas “announced the program as part of a new cooperation agreement with Mexico.” All by himself, the Domestic Security Minister cooked up “a legal pathway for Venezuelan nationals to enter the U.S.,” at least, for 24,000 of them.

They say it’s okay because “the humanitarian parole program requires Venezuelans to have a supporter in the U.S. to provide financial and other support, pass biometric and other security screenings, and complete public health requirements, including vaccinations.” It’s the same deal they gave Ukrainians fleeing Vladimir Putin’s troops.

Who are the sponsors?

Nobody who was already deported is eligible, Mayorkas hedged. That shouldn’t cut too many out of the herd. They can’t come in if they jumped the border illegally and they aren’t allowed to have “residence or refugee status in a country other than Venezuela.

Also, it will only continue as long as Mexico keeps taking Venezuelans back as required by their end of the deal.

Mayorkas issued a public statement announcing his loophole, noting his “actions make clear that there is a lawful and orderly way for Venezuelans to enter the United States, and lawful entry is the only way.” He broke the law to do it. The power-hungry bureaucrat ignored “congressional intent.” It also ignores precedent. It ” departs from how past administrations have exercised case-by-case parole authority.

This isn’t one case at a time on the merits, it’s blanket amnesty for Venezuelans. The cap is a fluid number. “The Secretary of DHS cannot legally ‘create‘ any such ‘pathway‘ and your assertion otherwise is just another example of how the Biden administration displays contempt for enforcing federal immigration law as set by Congress.

They weren’t taking the word of Mayorkas that only 24,000 would qualify. “They also cite a DHS staff briefing in which the 24,000 cap was said to only be an ‘initial commitment‘ and that the number could be revisited for a potential increase, while also saying that DHS officials have provided few details on who could sponsor parolees and how nationals would be vetted.” Illegal immigrants could end up sponsoring more illegal immigrants.

Specifically, the lawmakers say the sponsor system could mean that illegal immigrants whose removal had been deferred or temporary immigrants could be eligible to be a ‘supporter‘ for additional Venezuelan migrants.
