Joe Biden’s favorite scheme of granting “parole” to every migrant walking up to the border is about to be declared unlawful. Democrats can see the writing on the wall and are in total panic mode. Politico tried to soften the damage by bringing in an asylum lawyer to break the bad news to progressives.
Parole scheme has problems
Migrant Parole is definitely on the chopping block. Politico sat down for a deep interview with immigration lawyer Ava Benach, quizzing her about the chances for Congress to make a deal that lets Joe print money for Ukraine, Israel and Taiwan without yanking a corresponding amount from the cash earmarked for asylum.
“Negotiators plan to stay in touch throughout the weekend, but a deal feels increasingly out of reach, even as the White House pushes senators to forge ahead.”
Republicans seem determined to restrict the asylum system. Benach explains that they’re “definitely looking to make it harder to qualify for asylum.” There’s already been disturbing talk of “a rewriting of the ‘credible fear‘ standard that immigrants go through when they’re first screened for asylum eligibility, to make it harder to pass that screening.”

It’s the second rumor she’s heard which has her really panicking. “The second thing, I’ve heard, is to restrict the government’s ability to ‘parole’ people into the United States, which is a mechanism that allows the entry of people otherwise ineligible to enter.”
Besides that, Congress actually intends to “put some teeth back into the Safe Third Country agreements that the Trump administration entered into.”
They won’t even have a chance to ask for parole because they have to “demonstrate that they first sought asylum somewhere else on their journey to the United States.” Those hearings move pretty fast already.
Exhausted, confused, terrified
Migrants aren’t the only ones exhausted, confused, terrified. Border Patrol agents are stretched beyond the breaking point trying to keep up with the catch and release quotas.
They have to be packed through like cattle and granted parole right away because there are too many coming through to process correctly. The immigrants already have a hard time passing the test.
To be released free as a bird on parole into the heartland of America, migrants have to give all the right answers when their number is called.
Biden has released 1.5 million migrants on parole into the U.S in 2023. CBO says more than 4.5 million migrants will be paroled, and about 500K will alsoreceive asylum. They “have to recount the most traumatic experiences of their life to somebody through a translator — usually without legal assistance — over a video screen. If Republicans get their way, it “will result in fewer people passing that and being given the opportunity to present that application for asylum.”
The biggest problem confronting Democrats is the fact that “if you don’t have that parole authority, the only choice you have is to detain, unless you have a ‘Remain in Mexico‘ sort of situation.” That means they won’t be getting a bus ticket to New York City.
Ms. Benach is frustrated because such get tough policies won’t stop migrants from lining up at the border. She’s also intentionally missing the entire point. They can line up all they want but they won’t be getting in.
