Road Rage Escalates to Violent Scuffle Over Spray Paint Can

Harris County Constable Mark Herman never booked someone on assault with spray paint before but there’s a first time for everything. What started out as an ordinary case of road rage got twisted in Houston, Texas. The good news is that nobody was seriously injured.

Scuffle for the paint can

It was clear to see that two men sprayed each other in the face with white spray paint. According to Constable Mark Herman, of Harris County, Texas, on Friday, August 4, deputies responded to a road rage incident on the 24000 block of Kuykendahl Road, near Houston.

As deputies arrived on the scene, “they learned from the complainant that while he was driving north on Kuykendahl Road, the driver in front of him could not stay in his lane while he was looking at his phone.

Distracted driving isn’t a good thing but the observant driver didn’t bother the police with it. Things ramped up a notch at the next red light. While the traffic signal cycled through it’s phase, the distracted driver continued to focus on his government tracking device. The light changed and he just sat there.

As expected, that produced the obligatory honk from an already cheesed off driver behind him. One who’s fortune teller didn’t see spray paint in his future.

Thanks to what happened next, we know that the distracted driver is named Davis Winston. As “the victim” tried to pull around Winston, the accused “allegedly threw objects at the victim’s vehicle.

At the next stop, “an altercation broke out” involving the white spray paint.

A broken window too

According to the unidentified victim, after doing the manly thing and preparing to brawl in the street, Winston surprised him with a can of white spray, “which he used to paint the victim’s face and vehicle.

That fight didn’t quite go as the victim expected. “Winston was also accused of breaking the back window of the victim’s vehicle.

That didn’t stop the vigilante driver from getting in a few punches and eventually wrestling the spray can away from his opponent.

Police note “the victim also managed to spray paint Winston’s face during the fight.” Thankfully, there weren’t any children involved. No passengers or innocent bystanders are mentioned.

Deputies took the paint can into evidence and arrested Winston. After hauling him away to the Harris County Jail, for booking and processing, they charged him with criminal mischief.

That’s a felony in Texas so they set his bond at $1,500. It’s not clear if he has an attorney.
