Justice Ruth Bader Ginsburg wrote a majority opinion in Timbs v Indiana February 2019 before she died that may benefit Trump, even if she didn’t like him. He said he was going to replace her with Amy Coney Barrett, which he did once Ginsburg passed away.

Engoron thought Trump was guilty

He thought Trump inflated his property values to get better terms on his loans so he was fined $355 million plus $100 million every day in interest. Trump’s attorneys filed a request to stay the judgment for 30 days while the appeal was being prepared but Engoron denied it.

The notice of appeal was just filed. It’s likely that much of that appeal will be based on the Eighth Amendment which protects against excessive fines.

The Trump loans have been paid

His lawyers have said everything has been paid off according to terms, on time. There are no victims. The banks made a lot of money off Trump and would love to do business with him again, many said.

But that doesn’t matter. New York Attorney General Letitia James built her case on New York Executive Law 63(12) which doesn’t require damages be incurred in order to have a fine or whatever penalties imposed that the judge deems appropriate.

Trump Organization to be dissolved

Engoron wanted his organization dissolved in September but a New York appeals court gave him a stay til early October to give him a chance to appeal the ruling. The Associated Press analyzed 70 years of New York civil fraud cases under that law, a total of 150 cases and found that this case was the “only big business found that was threatened with a shutdown without a showing of obvious victims and major losses.”

Engoron decided against dissolution but he imposed a huge fine and barred Trump from being an officer or director in the organization for three years. His sons were barred from serving for two years.
