Special Counsel Jack Smith is on the ropes in terms of being able to prosecute Donald Trump.
Judge Aileen Cannon has dealt him another crushing blow.
This was after Smith had made a filing begging Cannon not to use Justice Clarence Thomas’ opinion in her ruling.
Case Dismissed
Cannon has dismissed the classified documents case against Donald Trump, a decision that fed off the opinion written by Justice Thomas in the presidential immunity case.
Thomas called into question the legality of the appointment of Smith.
He wrote, “If this unprecedented prosecution is to proceed, it must be conducted by someone duly authorized to do so by the American people.
“The lower courts should thus answer these essential questions concerning the Special Counsel’s appointment before proceeding.”
Based on his comments, Cannon decided that the appointment was, in fact, illegal, and the case would be dismissed.
Cannon stated, “Since November 2022, Special Counsel Smith has been exercising ‘power that [he] did not lawfully possess.’
“All actions that flowed from his defective appointment — including his seeking of the Superseding Indictment on which this proceeding currently hinges — were unlawful exercises of executive power.”
The entire left is now melting down.
For instance, Harvard Law professor emeritus Laurence Tribe added, “Judge Cannon clearly cannot be permitted to preside over this case.
“Whether she should be removed from the federal judiciary altogether is another matter.
“She probably should. Her ruling makes utter nonsense of the Presidential Records Act.”
The DOJ has already announced that it will appeal the decision, so this is far from over. However, it does mean the case will be delayed even more, at the very least, saving Trump from litigating this case before the election.
This cannot be viewed in any other way than a massive win for Trump.
However, make no mistake about it, the Democrats will now come after Cannon with everything they have.
