Former Trump Adviser John Eastman Refuses to Cooperate With Jack Smith

Jack Smith isn’t going to like hearing this news one bit.

Special Counsel Jack Smith has just learned that former Trump adviser John Eastman has set a clear boundary: he is not interested in making any plea agreements and refuses to cooperate with federal prosecutors.

According to Eastman’s attorney, Harvey Silverglate, his client provided “good faith legal advice” when he suggested former Vice President Mike Pence could refuse to certify President Biden’s election win.

Silverglate described Eastman’s counsel as “cutting-edge” and “creative” and expressed confidence that they would be able to find experts who verify it was within the realm of good faith legal advice.

In case Eastman is charged with anything related to this incident, he will take it all the way to trial and appeal any convictions if necessary. He won’t be making any deals with anyone.

Silverglate also noted how politicized this whole situation has become and called out the Department of Justice for its involvement as well.

He shared that despite their strong defense they are willing to provide information about their stance so as to prevent an indictment from being issued against Eastman.

Many defendants have already begun taking action in order to make sure their cases are handled correctly and fairly including seeking speedy trials and separate trials as well as trying to move their cases from state court into federal court.

According to The New York Times these actions matter because if the case stays in Fulton County where Trump lost the election then there will be more Democratic jurors but if it moves into a more rural area then those jurors may be slightly more sympathetic towards him.

But this doesn’t mean much as one not guilty vote can hang a jury so even this small advantage could prove very important.

For some defendants money might be another factor for wanting a speedy trial such as John Eastman who according to Silverglate is not wealthy enough nor does he have enough contributors like Donald Trump does meaning they must try and get through their process faster than some others might want to.

Brian Tevis, Atlanta attorney and negotiator for Rudolph W Giuliani’s bond agreement stated “the defense side would probably want potentially a year or so to catch up” due to how much longer prosecutors had on them before anything else was done about these cases.
