We just knew this was coming as soon as Judge Aileen Cannon dismissed the Trump classified documents case.
Hunter Biden’s legal team has filed to have his conviction overturned and his tax case dismissed, arguing that the special counsel appointment was illegal.
He is leaning into the same defense that Trump used to have his case dismissed.
Don’t Expect a Quick Ruling
When Cannon dismissed Trump’s case, she more or less put a freeze in play on every case that had been brought by a special counsel, including Hunter Biden’s cases.
If the courts find that the Attorney General overstepped his bounds by appointing a special counsel without the approval of Congress, the DOJ will have a big mess to clean up.
As I have stated in other reports, this issue was litigated more than two decades ago, resulting in Title 28, Chapter VI, Part 600, § 600.1.
This outlines the authority of the Attorney General to appoint independent counsel.
Based on the opinion of Justice Thomas in the presidential immunity ruling, this rule is now being challenged.
To that point, Hunter Biden’s team is arguing, “The Attorney General relied upon the exact same authority to appoint the Special Counsel in both the Trump and Biden matters, and both appointments are invalid for the same reason.
“Given that Congress requires a U.S. Attorney to be nominated by the President and confirmed by the Senate, it makes no sense to assume that Congress would allow the Attorney General to unilaterally appoint someone as Special Counsel with equal or greater power than a U.S. Attorney.
“That is what has been attempted here.”
I cannot get over the irony that the DOJ under Joe Biden is fighting this decision, while Hunter is trying to use the same defense to have his case dismissed.
Yet, the media, which blasted Trump for his defense, is not saying a word about Hunter using the same defense, nor is the White House blasting Hunter as it did Trump.
Just goes to show how biased our media is today based on the subject of the report.
