A report broke this week that New York Attorney General Letitia James is off a major case, only it is not the case that Donald Trump was hoping.
James announced that she was recusing her office from the prison abuse case regarding the death of Robert Brooks, who died after being beaten by several corrections officers while in custody.
One would think this is a case that she would prosecute, especially after seeing the video, but her office will be defending the corrections officers instead.
We Are Out
The video is labeled by YouTube as being too graphic for other websites to post, so you have to visit YouTube to see the actual beating of the prisoner (click here to see the video).
I have watched it, and it is tough to find any excuse those guards have for beating the man, especially since he was in restraints and there were numerous officers taking shots at him.
At one point, it almost seemed like the officers were just taking turns on him, so you can just imagine the outrage when this video was put out there.
James has decided to push the case on to Onondaga County District Attorney William J. Fitzpatrick.
James announced, “This decision is not one that was made lightly, but we believe this is the best course of action to protect the integrity of the investigation, and to ensure accountability and justice for Mr. Brooks.”
Governor Hochul also commented, stating, “Too much time has passed without changes being brought against the individuals responsible.
“The video of this horrific attack demonstrates that crimes clearly were committed, and I believe initial charges can be brought even as more serious charges are considered based on further investigation.”
Unfortunately, as I noted above, we do not have the full picture here, so I really don’t want to jump to any conclusions, but it is tough to imagine that prisoner did anything where guards could possibly be excused for putting him in restraints and beating him to the point that he likely died from his injuries.
And I say “likely” because I have not yet seen a coroner’s report to show that it was the beating that killed him rather than something other outstanding factor that we are unaware of.
