Mayorkas Waives 26 Environmental Laws to Build Border Wall

The Biden administration was trying to subvert a Republican rebuilding the wall by auctioning off parts of it. The Finish It Act required by law for that wall to be built. It’s already been paid for. Then Mayorkas has an about face and wants that wall up yesterday to the point of where 26 environmental laws are being waived. There was suddenly an “acute and immediate need”. Can you say “election”?

Mayorkas is a Democrat

Fox News reported in August,

“Steel ‘square structural tubes’ photographed in a storage lot in Arizona were listed for sale on GovPlanet, an online auction marketplace run by publicly traded Canadian company Ritchie Bros. Auctioneers, this month. Those 28-foot-tall hollow beams are ‘excess border wall materials that the U.S. Army Corps of Engineers turned over to the DLA for disposition and are now for sale,’ the Department of Defense’s logistics agency first confirmed to the Daily Upside and later the New York Post.”

Now the Department of Homeland Security is suddenly so desperate to build the wall that a bunch of environmental laws are being waived. Mayorkas declared,

“There is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to prevent unlawful entries into the United States in the project areas. In order to ensure the expeditious construction of the barriers and roads in the project areas, I have determined that it is necessary that I exercise the authority that is vested in me by section 102(c) of IIRIRA [Illegal Immigration Reform and Immigration Responsibility Act of 1996].”

Mayorkas has his reasons

There are probably a number of them. The Washington Times reported that the IIRIRA

“gives the Homeland Security secretary the power to waive laws when necessary to facilitate border construction.  Mr. Mayorkas’s waiver covers 26 federal laws, including the Endangered Species Act, the Clean Air Act, the Clean Water Act, the Eagle Protection Act and the Native American Graves Protection and Repatriation Act.”

Where’s Biden in this? He had promised during his campaign that, “not be another foot of wall constructed”. When he was inaugurated he said the wall was a “waste of money that diverts attention from genuine threats to our homeland security.”

Mayorkas was of the same mind

The Homeland Security Secretary had already done an about face on border wall construction. This was just the most showy effort done about fast tracking it through the IIRIRA. We’ve had a new wave of immigrants coming from Venezuela. That might have caught his attention.

Nearly half a million illegal Venezuelans already have been granted work permits. The administration is just turning on a dime when it looks like the public isn’t too thrilled with them. It’s nice to see the administration admitting that walls work, even if it’s belated.  But it’s not going to stop the border problem overnight.
