Is there some maneuvering going on behind the scenes to rig the classified documents case against Donald Trump?
If a recent report is correct, that is exactly what is happening.
Former U.S. Attorney Joyce Vance believes that Special Counsel Jack Smith has made a move that could remove Trump-appointed Judge Aileen Cannon from the case.
Legal Moves
Smith has requested a December trial date, and we all know why.
He is hoping to drag this out into the primary season to hurt Trump and possibly derail the entire GOP primary race. Trump, on the other hand, will look to have this delayed until after the race, which is what Smith is banking on.
There is another motive, however, as Vance points out in her column, which could be to have Judge Cannon outright removed from the case to get a friendlier judge for Smith on the bench.
Vance wrote, “It’s a bit of a double-edged sword for Trump.
“He could agree to the December date, which he won’t do, at least not without the intention of asking for a continuance as that date gets closer.
“If Trump objects to a December trial and asks for a date after the first of the year, the government will undoubtedly demand a ruling that he cannot use rallies, campaign events, and primary dates as an excuse for further delay.
“Since it would be entirely reasonable, under the government’s proposed schedule, to try the case in December, if Trump asks for additional leeway and the Court grants it, there is no reason it shouldn’t come with conditions that ensure the people get their right to a speedy trial.”
The move by Smith here is baiting Trump to ask for a delay in the trial.
According to Vance, there is no apparent reason why a delay should be requested or granted but if it were, it would set the table for preferential treatment to Trump by Cannon, which is where Smith could make his move.
Vance continued, “There’s no legitimate reason for an extended delay before trial and certainly no reason to delay it until after the 2024 election, more than a year off.
“A ruling to that effect from Judge Cannon would likely provoke renewed concern about her ability to handle the case in a fair and unbiased way.
“Expect Trump to make the motion, but a decision by the judge to move the trial that far off would be unprecedented.”
We have to assume that Trump’s attorneys are well aware of this, so they know they are already walking a thin line.
The good news for Trump is that he is likely to get a friendly jury in Florida, so the case should work out in his favor, that is as long as he can keep Cannon on the bench.
