Trump had been hoping to lower his legal caseload by one.
His attorneys had filed a motion to have the original defamation suit by author E. Jean Carroll tossed.
A judge rejected the motion, so this is one more issue that Trump will have to face as we roll into the primary season.
Denied
Once again, the outcome was decided long before any arguments were heard.
Judge Lewis Kaplan, a Bill Clinton appointee, presided over the case.
Since we have yet to see any Democrat-appointed judge rule in favor of Trump, this ruling is not exactly a shock.
The decision was handed down on Thursday.
Kaplan stated, “It is a not a ‘get out of damages liability free’ card that permits the president to say or do anything he or she desires even if that conduct is disconnected entirely from an official function.”
Keep in mind, after the initial case was settled in court, with Carroll being awarded $5 million in damages, Trump continue to rant about Carroll on social media.
Carroll’s lawyer Roberta Kaplan stated the ruling “confirms that once again, Donald Trump’s supposed defenses to E Jean Carroll’s defamation claims don’t work.
“Trump chose to waive presidential immunity and now he must live with the results of that decision.
“Today’s decision removes one more impediment to the January 15 trial on E Jean’s defamation damages in this case.”
Just one more red flag hanging over Trump’s head as he hopes to win the GOP nomination and face off against Joe Biden for a second time in 2024.
